EU — AI × Entertainment Regulation¶
⚠️ Not legal advice. → Comparison by country / Cross-cutting overview (Japanese) Japanese edition: ../../../ethics-legal/by-country/eu.md
Training¶
- Text and data mining (TDM) exception; rights holders can opt out
- EU AI Act obligations for general-purpose AI models: apply from August 2, 2025. Providers publish a training-data summary using the prescribed template (models placed on the market earlier have until August 2, 2027). AI Office enforcement from August 2, 2026
Labeling & transparency (AI Act Article 50, applies from August 2, 2026)¶
| Provision | Content | Impact on entertainment |
|---|---|---|
| Art. 50(1) | AI that interacts directly with people must inform them it is AI (unless obvious from context) | Directly affects conversational NPCs and AI characters |
| Art. 50(2) | Machine-readable marking of synthetic audio, image, video, and text outputs. Systems placed on the market before August 2, 2026 have until December 2, 2026 for this paragraph only | Providers of generation tools and features |
| Art. 50(4) | Deployers publishing deepfakes must disclose that they are AI-generated. For evidently artistic, creative, satirical, or fictional works, it is enough to disclose "the existence of generated content" in a way that does not hamper enjoyment | Film and game works |
- There is no obligation to retroactively label content generated before August 2, 2026
Personal data¶
- GDPR: conversation logs and memory data, age verification. In May 2025 the Italian data protection authority fined AI companion Replika €5 million (→ case C04)
Implications for entertainment businesses¶
- 💡 The EU's labeling duties are the most specific. Building in both visible labels and machine-readable marks from the start also makes it easier to meet Chinese and Korean requirements
- Artistic works get allowances in how they are labeled, so disclosure in end credits or work information is realistic
